We have successfully defended estates against lawsuits by alleged creditors in civil litigation.  If an estate rejects a creditor's claim, the creditor must file a civil suit against the personal representative.  It is no longer a probate matter and is handled like any other civil suit; however, there are particular issues that typically arise in these matters which make them more complex than the average creditor lawsuit.  

Beneficiary Disputes

There are often disputes between beneficiaries including will contests and allegations of breach of fiduciary duty by personal representatives.  These cases often involve family members who have lost a family member and are facing complex issues regarding the transfer of assets.
